I had no other clerical subordinates to whom I

could delegate this duty in my absence and that of the Assistant Harbour Master, under paragraph 2 of Treasury Circular of 18.12.09,

as the whole of my clerical staff were Chinese, with one exception,

who was not always available.

I cannot imagine what grounds there are for

this statement, which is quite at variance with the facts, es is

the further one, that "Paragraph 4 has been ignored".

No evidence nas been adduced in support of any

of the above conrges, none, tuat is, to my knowledge, nor have I had any opportunity of refuting any such evidence which Lay have been advanced without my knowledge. In all three of the reports referred to, which constitute the whole case against me, there is

conclusive evidence of confusion of ideas which has led the

writers into mistakes. Statements are made on insufficient grounds, or on no grounds at all, and conclusions are arrived at which are not borne out by facts, and which are based upon misconception.

Sir Frederick Lugard, in his minute of 5.11.10,

accepted these statements, and on 11.11.10, I attempted to point the misconceptions upon which they were based.

Up to the date of my leaving the Colony on lea-

-ve, on 1.2.1l, no further communication on the subject reached me, but after I arrived in England I was provided by the Colonial Office, on 14 June, 1911, with a copy of Sir Frederick Lugard's minute of 19.11.10, which I had not previously seen. From this I gather that, following upon my explanations, most of which he accepted, but one of the original charges remained. This was
